ESA protected roms

I have two questions concerning ESA protected roms if anyone would be so kind as to help me out.

Is it illegal to download/obtain or play ESA protected roms?

Is it legal but immoral?

I want to avoid doing anything illegal and that is one reason why I am asking this question. Thanks for any help in advance.

Downloading ESA protected roms is more illegal than downloading the ordinary non-ESA protected roms.
