xbox backward compat issue

I Downloaded the default.xex patch and have burned it to a cd and dvd, when I put it in the tray, I get a message that the system "has been updated" to play older games, but when I put in any old disc, I get a message that says I need to download the game again. we tried it on xbox live as well, with the same results. Anyone have any ideas? thanks
