Emulators are created without using any original IP or copyright technology or code which is why they aren't distributed with roms or bios files. So technically emulators don't need permission to be released because they don't infringe any of the original copyrights.

Different publishers have different levels of unofficial support for emulation and the homebrew community. None will support it directly or officially and Nintendo in particular will take action where it can to prevent use of anything thats not a licenced Nintendo product.

The only legal free roms are one's that have had explicit consent from the copyright owners to be distributed for free. In every other case (regardless of what original games you might own) they are illegal which is why Emulator Zone doesn't support or allow the linking to or discussion of where to find roms and romsites.
